Educational law as it relates to the education of your child, addresses schools, teachers and the rights of students to a public education. Drawing from her background, Johnna Baker has a working knowledge of state and federal laws that impact students and schools. If you have a student with a disability, federal laws have been implemented in recent years that grant children with disabilities certain rights. The Equal Education Opportunities Act, of 1974 provides that an individual cannot be denied an equal opportunity to an education based on race, color, national origin, or sex. The Individuals with Disabilities Act (IDEA) establishes a process for evaluating students with disabilities and providing a tailored plan to meet those individual needs. IDEA also gives parents and guardians of special education students the right to have their child tested, the right to review records, attend an individualized education program (IEP) meeting and have input to the IEP plan. If you are a parent or legal guardian of a special needs student and you feel your child has been treated unfairly in a school setting you have a right to take this dispute with a school system to a third party. Understanding the New Alabama Anti-Bullying/Cyber-Bullying Law)
When the new school year begins in August, there will be a new law in effect to help protect students from bullying/cyber-bullying. Recently, Johnna Baker was interviewed by Mike Dubberly on "Good Day Alabama" on WBRC-6 about HB366, a comprehensive anti-bullying law which passed the state legislature last March. This new Alabama law will require school programs on anti-bullying/cyber-bullying.
